These Terms and Conditions govern the use of this website and the engagement of legal services provided by Mahligai Kasih, a family law practice located at Lot 8-2, Jalan Imbi, 55100 Kuala Lumpur, Malaysia. By accessing this website or instructing us to act on your behalf, you acknowledge and accept these terms. If any part of these terms is unclear, please contact us before proceeding.
These terms are written in plain English as far as is practicable. Where legal concepts are necessarily involved, we have aimed to explain them in a way that is accessible. If you require clarification on any point, we welcome your enquiry.
1. About This Practice
Mahligai Kasih is a family law practice registered and operating in Malaysia. We are regulated by the Malaysian Bar and subject to the Legal Profession Act 1976. All solicitors practising under the Mahligai Kasih name hold a valid Practising Certificate issued by the Malaysian Bar.
Our primary focus is family law matters under Malaysian civil law, including proceedings in the Sessions Court, High Court, and Court of Appeal where appropriate. Where Syariah law applies to a client's situation, we will explain the applicable framework and, where necessary, refer to or coordinate with qualified Syariah practitioners.
2. Use of This Website
This website is provided for general information about Mahligai Kasih and the services we offer. The content on this website does not constitute legal advice and should not be relied upon as such. Family law matters are fact-specific; the general information on these pages may not apply to your individual circumstances.

4. Engagement of Legal Services
A solicitor-client relationship is established only when we have agreed in writing to act for you. This agreement is confirmed by a formal engagement letter, which will set out the scope of our instructions, the applicable fees, and the terms of our engagement. An initial consultation does not, by itself, create an ongoing obligation on either party.
You should not act upon anything said during an initial consultation as definitive legal advice for your specific matter until a formal engagement letter has been issued and accepted. The engagement letter takes precedence over any general information provided on this website or during a preliminary discussion.
4.1 Scope of Instructions
We act only within the scope of the instructions set out in the engagement letter. If your circumstances change and you require advice on matters outside that scope, please inform us so that we may consider whether and on what terms we can assist you further.
4.2 Your Obligations to Us
To enable us to advise and represent you effectively, we ask that you:
- Provide us with full and accurate information relevant to your matter
- Respond to our communications within a reasonable time
- Attend appointments as agreed, or give adequate notice if you need to reschedule
- Inform us promptly of any change in your circumstances that may affect the matter
- Settle our invoices in accordance with the payment terms agreed
We are entitled to withdraw from an engagement if you provide us with false or misleading information, or if circumstances arise that make it professionally improper for us to continue.
5. Fees and Payment
Our fees for the services described on this website are set out on the relevant pages. These fees are inclusive of the solicitor's professional time for the matters described. They do not include court filing fees, stamp duty, disbursements, or any third-party costs unless expressly stated.
For matters that extend beyond the scope of a fixed-fee service, we will discuss our hourly rate and provide an estimate before proceeding. Where the final cost is likely to differ materially from an initial estimate, we will inform you as early as possible.
Invoices are payable within 14 days of issue unless otherwise agreed in writing. We reserve the right to suspend work on a matter if invoices remain unpaid and no payment arrangement has been agreed.
All fees are stated in Malaysian Ringgit (RM) and are subject to the applicable rate of Service Tax where required by Malaysian law.
6. Confidentiality and Legal Professional Privilege
All communications between you and Mahligai Kasih in the context of a legal engagement are subject to legal professional privilege. We will not disclose the contents of your matter to any third party without your consent, except where we are required to do so by law or by the rules of the Malaysian Bar.
Legal professional privilege belongs to you as the client. You may waive it, but we may not. If you instruct us to disclose privileged information, we will do so only after confirming that you understand the implications of that disclosure.
Where we are required by Malaysian law — including anti-money-laundering obligations — to report certain matters to the relevant authorities, we will comply with those obligations. We will inform you of any such reporting to the extent that we are legally permitted to do so.
7. Conflicts of Interest
Before we accept instructions, we carry out a conflict-of-interest check. If we identify a conflict — for example, if we already act for, or have recently acted for, the other party in your matter — we will inform you promptly and will not act for you in that matter.
We generally do not act for both parties in a family dispute, even where both parties initially consent. Family law matters often develop in ways that create competing interests, and we consider it important that each party has independent advice.
8. Limitation of Liability
Our liability to you in connection with any matter is limited to direct losses arising from our negligence or breach of duty. We do not accept liability for indirect, consequential, or special losses, including loss of income or opportunity, except to the extent required by applicable Malaysian law.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
Where we introduce you to or recommend a third-party professional (such as a mediator, financial advisor, or Syariah practitioner), we are not responsible for the advice or conduct of that third party.
9. Intellectual Property
All content on this website — including text, layout, design, and documents — is the property of Mahligai Kasih or its content licensors and is protected by Malaysian copyright law. You may print or download material for your own personal, non-commercial use. You may not reproduce, redistribute, or use any content for commercial purposes without our prior written consent.
Documents prepared by us for you in the course of a legal engagement belong to you once our fees for that work have been paid in full. The underlying precedents, templates, and working documents used in preparing those documents remain our property.

11. Governing Law and Disputes
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from the use of this website or the provision of our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
We encourage clients with concerns about our services to raise these with us directly in the first instance. We are committed to addressing any dissatisfaction promptly and thoughtfully. Where a complaint cannot be resolved directly, you have recourse to the Advocates and Solicitors Disciplinary Board of Malaysia.
