What is the difference between civil and Syariah divorce in Malaysia?
Muslim marriages in Malaysia are governed by the Syariah courts of the relevant state. Non-Muslim marriages are handled under the Law Reform (Marriage and Divorce) Act 1976 in the civil courts. The applicable law depends on the religious status of the parties at the time of marriage. We will advise you clearly on which framework applies to your situation at your first meeting.
How long does a divorce typically take in Malaysia?
For uncontested civil divorces where both parties have agreed on all matters, the process often takes between three and six months from the date of filing. Contested matters, or those involving complex property or custody disputes, may take considerably longer. We share a candid timeline estimate before any formal filings are made.
Do I need to attend court?
In many uncontested proceedings, a personal attendance may be limited or handled efficiently. However, Malaysian courts do require certain appearances. We will tell you in advance exactly when and where you need to be present, and we accompany you through each stage.
What information should I bring to the first consultation?
It is helpful to bring a copy of your marriage certificate, your MyKad, and any existing agreements or correspondence with your spouse if they exist. Beyond that, you need not prepare anything specific. The consultation is a conversation, not a formal examination.
Is everything discussed in our meetings confidential?
Yes. All communications between a client and their solicitor are protected by legal professional privilege under Malaysian law. What you share with us remains within these chambers unless you direct otherwise, or unless a specific legal exception applies — which we would explain to you openly.
Can both spouses engage the same firm?
No. Each party in a matrimonial matter requires independent legal representation to safeguard their own interests. We represent one party only. We are happy to refer the other party to a suitable independent solicitor if that is helpful.
